Accepting these terms

These terms are an agreement between you and Stripey ("we", "us") covering the Stripey app for iOS and Android and this website. By installing or using Stripey you agree to them. If you do not agree, please do not use the app.

If you downloaded Stripey from the App Store or Google Play, Apple's or Google's own terms also apply to your download and to any purchase.

Your license to use Stripey

We give you a personal, non-exclusive, non-transferable license to install and use Stripey on devices you own or control, for your own use. Stripey and everything in it other than your content, including the app, its design, the tracer looks and the Stripey name and mascot, belong to us. You may not copy, modify, sell, rent, reverse engineer or redistribute the app except where the law allows it regardless of these terms.

Your content

Your videos, and the traced videos you export, are yours. Stripey does not claim any rights to them. Because the app runs entirely on your device and nothing is uploaded to us, we never receive, store or see your content.

You are responsible for the videos you import and for what you do with your exports. Only import video you have the right to use, and make sure you have permission from anyone who appears in it before you share it.

Stripey Pro

Everything in Stripey is free to use. Stripey Pro unlocks unlimited exports. It is an auto-renewing subscription, offered weekly or annually, billed through the App Store or Google Play at the price shown in the app before you buy. There is no free trial.

• Renewal. Your subscription renews automatically at the end of each period until you cancel. Your store account is charged for the next period within 24 hours before the current one ends.
• Cancelling. Cancel any time in your App Store or Google Play subscription settings. Cancelling stops future renewals; you keep Pro until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
• Refunds. Purchases are made through Apple or Google, so refunds are handled by them under their policies. We cannot issue refunds directly.
• Price changes. If a price changes, the store will tell you before it applies to your next renewal, and you can cancel before then.

Acceptable use

Use Stripey lawfully and decently. Do not use it to create or share content that infringes someone else's rights, that is unlawful, or that harasses or harms others. Do not attempt to interfere with the app, bypass the subscription, or misrepresent Stripey as your own.

Disclaimers

Stripey is provided "as is" and "as available". We do our best to make it reliable, but we make no promises that it will be error-free, uninterrupted, or that the tracer will be accurate for any particular shot. The tracer follows the points you tap; the distances and shapes it draws are for entertainment and are not measurements. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Keep a copy of videos you care about. Stripey stores everything on your device, so a lost, reset or replaced phone means lost swings, and we have no copy to restore.

Limitation of liability

To the fullest extent permitted by law, Stripey will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content or profits, arising out of or related to your use of the app or this website. Our total liability for any claim relating to Stripey is limited to the amount you paid us for Stripey Pro in the twelve months before the claim, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow these limits, so they may not apply to you.

Termination

You can stop using Stripey at any time by deleting the app; cancel any subscription in your store settings first. We may end or suspend your license if you break these terms. The sections on your content, disclaimers, limitation of liability and governing law survive termination.

Changes to these terms

We may update these terms as Stripey changes. When we do, we will post the new version here and update the effective date. If a change is material, we will say so in the app or on this site before it takes effect. Continuing to use Stripey after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in California, and you consent to their jurisdiction. Nothing here takes away rights you have as a consumer under the laws of the place you live.
